DEFINITIONS

"User" means the person or entity using the website. "Owner" means the company that owns the website, The Hobbyman Pty Ltd "Service Provider" means the company providing the website content management system and hosting services to the Owner for the website. "Website" means "http://www.hobbyman.com.au/"

PRE-SALES / PRE-POST CREDIT CHECKS:

All orders of large quantities amounting to "$300+ aud or at to our discretion" will be subject to credit checks before finalisation of sales & postage.

PRE-ORDERED ITEMS:

Where there it is a limited edition product, new release or a non stock item we will ask for firm commitment: a deposit or a payment in full. When placing a deposit or pre-ordering an item you are accepting that this is not refundable. In the case we can not confirm the price upfront and the price is substantially different to what was advertised then we will accept to refund the deposit otherwise in any other case the deposit is non refundable.

Pre-order item prices may change upon receipt of products in store. This price may change due to manufacturer request/situations out of our control.

LAYBY POLICY:

To lay-by one or more items, we require a deposit of 50% of the total amount. To lay-by your order, please call us during business hours or visit our superstore at Fountain Gate. Our lay-by policy term is 3 months. If you require more time to complete your lay-by purchase, please let us know and we will do our best to assist you.

PRICE MATCH POLICY:

The Hobbyman will always try to match a competitor’s price. Unfortunately, there are some limitations that can prevent us from some price-matching.
- The price-matched item must be the precise item (not a variation on the item) and it must be physically in-stock and available in an Australian-based store (ie not eBay, Temu,
Amazon, Catch, etc)
- The price is a landed price (that is, a price that includes postage/freight to you or us). Subsequent freight costs (if applicable) out to you would be added to the matched price
- We can’t price match on a clearance item or part of a discount store, auction, liquidator, second-hand dealer or overstock sales platform
- Some items may be excluded from our price match policy at the manager’s discretion, such as limited edition releases or if the price goes below our buy price.

DELIVERY POLICY:

FREIGHT PRICING:

Our Pricing for deliveries, works according to the delivery zone in which the orders are delivered to and the Freight Weight of Goods. Simply use our delivery estimator in the Payment screen of the shopping cart to get an up-to-date estimation on delivery costs specifically for your order. The Hobbyman does deliver to Australian Islands off the Mainland but all on-forwarding costs incurred for shipment of goods to Islands Off the Australian Coastline will be at the customer's discretion. FREE DELIVERY:

Delivery is free for orders of $250.00 or more (excluding items classified as Big and Bulky) to metropolitan areas in Brisbane, Melbourne, Perth, Hobart & Sydney. If you are in those delivery areas and your order is less than $250.00, you will be charged a delivery fee appropriate to the State or Territory, and size of goods. For deliveries to areas outside the main metropolitan centres you may be charged (at our discretion) for an order of any value.

SAME DAY DELIVERY:

The Hobbyman Pty Ltd does not run a same day delivery service.

DELIVERIES:

The processing of orders and all deliveries are made Monday to Friday excluding public holidays. We currently do not have a weekend delivery service. Metropolitan area's are in most cases (for smaller deliveries) next day if the order is placed before 3pm, where as larger items to Metropolitan area's may take up to 2 days if placed before 12pm, with Perth Metropolitan area taking in some cases up to 3 days. Items heading outside the Metropolitan Area's may take an additional 2 to 3 days. During the "wet season" deliveries into Northern Territory and Northern Queensland may be affected by adverse weather conditions. In this event, deliveries may take longer than our usual timeframes. Large and Bulky Items:

Orders weighing over 20kg of Freight Weight eg. (1 cubic metre = 250kg) may be subject to an additional delivery fee, as they are outside our standard delivery criteria. A Hobbyman representative from the Customer Service Centre will contact you and confirm the additional delivery fee. If you have any queries about this please call (03) 9705 6880 Monday to Saturday 10:00am to 6:00pm Deliveries to Post Office Boxes:

A physical street address is required for delivery in most cases. Post Office Boxes cannot be used as a delivery address for large or bulky items. This is because Freight Companies other than Australia Post will not deliver any goods to Post Boxes.

DELIVERY SIGNATURES:

Large and Bulky Items, in some cases, are not left at an address unless signed for, please state in Delivery Notes that you may not be home at time of delivery so we can mark items as not requiring a Signature. Items not signed for are not insured, so if possible send to an address where a signature is guaranteed, eg Place of Work

INTERNATIONAL SHIPPING:

At this stage we only ship to areas within Australia, and New Zealand only. The prices quoted on our shipping orders are those supplied to us by Australia Post. They were correct as of January 2016, and are updated periodically. If you are shipping via standard AIR MAIL, please allow up to 21 standard business days for delivery of your order.

We'll go all out to help you choose the right combination of products for your hobbying needs. And we'll bend over backwards to make sure you're satisfied. But there's a limit to everything. And here's ours:

We cannot accept responsibility for injury and/or crash damage or loss of kits, engines and accessories, parts and materials that occurs during the use of any radio-controlled model. The user shall determine the suitability of the product for his or her intended use and shall assume all risk and liability in connection therewith.

If you substitute or replace normal kit hardware and/or radio components with after-market accessories, The Hobbyman cannot be held responsible for problems or equipment failure caused by incompatibility or modifications. This includes all other products sold by The Hobbyman.

GENERAL ERRORS:

The Hobbyman makes every effort to ensure the accuracy of the information published here and on our Web site. However, the documents and graphics published on this site may contain technical inaccuracies or typographical errors. The Hobbyman makes no representations about the suitability of the information and graphics presented on this site. All such documents and graphics are provided "as is" without warranty of any kind.

PRICING ERRORS:

If an error is made and a product is listed at an incorrect price, The Hobbyman shall maintain the right to refuse or cancel any orders placed at the incorrect price. If the order has been confirmed and charged to you, The Hobbyman shall immediately issue a credit in the amount of the incorrect price.

The Hobbyman By Hearns makes use of various payment methods that are readily available to all customers. As such each payment method has its own TOS, Privacy Policy and T’s & C’s, we advise you appraise yourself of the payment method of your choice before proceeding if you are unsure.

AUSTRALIAN CONSUMER LAW OUTLINE:

All goods sold in Australia come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. There are consumer guarantees that apply to goods you purchase:

• Acceptable quality

• Fit for a particular purpose

• Match description

• Match the sample or demonstration model

Consumer guarantees cannot be excluded and are in addition to any extended warranty you purchase or any voluntary warranty (warranty against defects) you are given. There may be circumstances where you are not entitled to a remedy.
